These Terms of Service ("Terms") govern your use of OvanFix, operated by Ovan ("we", "us", "the Service"). By accessing or using the Service you agree to these Terms.
1. Service description
OvanFix is a multi-tenant maintenance management (CMMS) platform. It allows organizations to manage work orders, assets, locations, materials and related operational data via web and mobile apps.
2. Accounts
You access OvanFix through a tenant managed by your organization. Your tenant administrator may create, modify or revoke your account at any time. You are responsible for keeping your credentials secure and for all activity under your account.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to other tenants' data.
- Reverse-engineer, decompile or otherwise tamper with the Service.
- Submit content that is defamatory, infringing or harmful.
- Use the Service to spam, scrape or overload our infrastructure.
4. Data ownership
Your tenant retains ownership of all data you upload (work orders, photos, assets, etc.). We act as a processor and store the data on your behalf. You can request export or deletion at any time via your tenant administrator.
5. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with prior notice, and may need to perform emergency maintenance without notice.
6. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
7. Limitation of liability
To the maximum extent permitted by law, Ovan shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use of the Service. Our total liability for any direct damages is limited to the fees paid by your tenant in the 12 months preceding the claim.
8. Termination
We may suspend or terminate access if you violate these Terms. You may stop using the Service at any time; ask your tenant administrator for account deletion.
9. Changes
We may update these Terms. Material changes will be announced via in-app banner or email. Continued use after changes constitutes acceptance.
